EB-5 Visa

EB-5 Visa

"You are one step closer to obtaining the EB-5 Visa."

Given the lack of a bilateral agreement regarding investor visas between Brazil and the United States, the EB-5 visa has become a highly attractive option for those seeking to reside permanently or for an extended period in the United States, as any citizen is eligible to apply for it. It is a complex but highly advantageous visa, as it allows for direct obtainment of the coveted green card. Like all other visas, this visa has specific requirements that must be strictly followed. Below is an outline of these requirements:

  1. The investment must be in a business, not in investments such as the stock market.
  2. The investment must come from the applicant’s own funds and from lawful sources that demonstrate the origin of the money. It can be a gift from a relative or another person, but taxes must be paid if required, and the source of funds must be documented and proven.
  3. The investment amount is $1 million in your own business, but if it’s through a Regional Center, it reduces to $500,000.
  4. For a $1 million investment, direct job creation of 10 jobs is required. If investing through a Regional Center, both direct and indirect job creation is required.”

The investment can come from a contribution of various forms of capital, including cash, equipment, inventory, property, and other tangibles. A $1 million investment must be applied to a business of your own (such as a restaurant) and create 10 new direct jobs. However, $500,000 is acceptable if the business is located in a targeted employment area, aiming to generate new jobs. These areas are typically rural or have an unemployment rate of at least 150% of the national average, as designated by the U.S. Office of Management and Budget.

The EB-5 Visa is currently a very popular choice for many foreign business investors due to the security offered by the United States compared to the uncertainty in their home countries, as well as the political instability in various South American countries. There are three distinct categories within the EB-1 visa, each of which has specific eligibility criteria:
